OpenAI Removes Mentions of the "IO" Brand Over Trademark Dispute

OpenAI was forced to remove online content related to its recent deal with former Apple designer Jony Ive's startup following a trademark complaint. The company removed promotional materials, including a video in which Ive and OpenAI CEO Sam Altman discuss the $6.4 billion (CZK 160 billion) transaction.

The legal complaint was filed by iyO, a Google-backed startup that makes AI-powered earbuds. The dispute centers on alleged trademark infringement, with iyO claiming that the OpenAI and io branding encroaches too heavily on its established position in the custom earphone market.

Background to the Dispute and the Parties Involved

iyO describes itself as the creator of the "world's first audio computer"—custom earphones that connect to other devices. The company attempted to partner with or be acquired by OpenAI, proposing investment, licensing, or an outright sale for $200 million (CZK 5 billion). OpenAI rejected these offers.

Jony Ive left Apple in 2019 after a 27-year career as one of the technology company's leading product designers. His design credits include the first iPod, iPhone, MacBook Air, Apple Watch, and AirPods. In the promotional video, Ive said: "I have a growing sense that everything I have learned over the last 30 years has led me to this place, to this moment."

Details From Legal Filings

Court filings reveal interesting details about the device's development. Emails submitted to the court show that OpenAI and io executives were aware of iyO's in-ear device and even requested a demonstration. The io team acknowledges that it researched the market and purchased various earphones and headsets as part of its research.

The legal documents also reveal that in 2022, iyO's CEO attempted to recruit key design talent from Apple, suggesting longstanding awareness and competition between the teams.

The Upcoming Device Is Not Wearable

According to court filings and statements from io's co-founders, its device is not wearable or similar to iyO's custom earphones. The prototype is not complete and is not intended for sale in the near future. According to reports, the AI device will be "unobtrusive" and capable of fully perceiving the user's surroundings and life. It will sit on the user's desk and complement the MacBook Pro and iPhone.

Altman told Bloomberg in May: "Just as the smartphone did not cause the laptop to disappear, I don't think our first thing will cause the smartphone to disappear. It's a completely new kind of thing."

Current Status of the Dispute

OpenAI said it temporarily took down the page announcing its acquisition of io due to a court order following a trademark complaint from iyO. "We disagree with the complaint and are considering our options," an OpenAI spokesperson said.

The dispute does not affect the deal itself, under which Ive's company will assume creative and design leadership within the merged businesses. The fruits of the Ive-OpenAI partnership are not expected until next year.

The legal dispute continues, with both sides presenting evidence concerning product differentiation, branding, and prior knowledge of each other's technology plans.
