Denmark Becomes the First Country in Europe to Give People Copyright Over Their Own Bodies to Combat Deepfakes

Denmark is set to become a pioneer in the fight against deepfake technology. The Danish government has unveiled a plan to amend copyright law to give every citizen rights over their body, facial features, and voice. A Groundbreaking Law, the First of Its Kind in Europe

On Thursday, the Danish government announced that it intends to strengthen protection against digital imitations of human identities with what it considers the first law of its kind in Europe. The Ministry of Culture has secured broad cross-party support and plans to submit the proposal for public consultation before the summer holidays and subsequently present it to parliament in the autumn.

Danish Culture Minister Jakob Engel-Schmidt expressed hope that the bill would send an "unequivocal signal" before parliament that everyone has the right to control how they look and sound. In an interview with the Guardian, he said: "In the bill, we agree and are sending an unequivocal signal that everyone has the right to their own body, their own voice, and their own facial features, which is clearly not how the current law protects people against generative AI." The minister further emphasized: "Human beings can be run through the digital copying machine and be misused for all sorts of purposes, and I am not willing to accept that."

How the New Legislation Will Work

Once approved, the amendments to Danish copyright law will theoretically give people in Denmark the right to demand that online platforms remove such content if it is shared without consent. The law will also cover "realistic, digitally generated imitations" of artistic performances created without consent. Violations of the proposed rules could result in compensation for those affected. The government stated that the new rules would not affect parody and satire, which will remain permitted.

Broad Political Support

The move, which reportedly has the support of nine out of ten members of parliament, comes amid rapidly evolving AI technology that has made it easier than ever to create convincing fake images, videos, or audio that mimic another person's features. Engel-Schmidt noted: "Of course, this is new ground that we are breaking, and if the platforms fail to comply with this, we are willing to take further steps."

The minister hopes that other European countries will follow Denmark's example. He plans to use Denmark's upcoming EU presidency to share his plans with his European counterparts. If technology platforms do not respond appropriately to the new law, they could face "severe fines," he said, and the matter could be referred to the European Commission. "That is why I believe the technology platforms will take this very seriously," he added.
